LA CROSSE, Wis. (WXOW) – Erik Sackett of La Crosse is charged with first-degree intentional homicide in the death of 35-year-old Erin Somvilai and Wednesday his defense team attempted to throw out evidence in the case obtained from a cadaver dog during the investigation.

Sackett is accused of killing Somvilai in June 2018. Her body was later found in a Vernon County Lake.

Judge Elliot Levine ruled not to decide at this time. The court will re-examine the motion at Sackett’s next appearance set for August 28.

Last month, Judge Levine ruled that body camera evidence from police could be shown to the jury in his upcoming trial.

He’s scheduled to go to trial on the homicide charge in late October.

Sackett is currently jailed in La Crosse County on a $1 million cash bond.
